الاستدلال بقول : المسألة فيها خلاف
لفضيلة الشيخ صالح بن فوزان الفوزان حفظه الله
قال الله تعالى: (وَأَنَّ هَذَا صِرَاطِي مُسْتَقِيماً فَاتَّبِعُوهُ وَلا تَتَّبِعُوا السُّبُلَ فَتَفَرَّقَ بِكُمْ عَنْ سَبِيلِهِ ذَلِكُمْ وَصَّاكُمْ بِهِ لَعَلَّكُمْ تَتَّقُونَ) [الأنعام: 153]، وقال تعالى: (يَا أَيُّهَا الَّذِينَ آمَنُوا أَطِيعُوا اللَّهَ وَأَطِيعُوا الرَّسُولَ وَأُوْلِي الأَمْرِ مِنْكُمْ فَإِنْ تَنَازَعْتُمْ فِي شَيْءٍ فَرُدُّوهُ إِلَى اللَّهِ وَالرَّسُولِ إِنْ كُنتُمْ تُؤْمِنُونَ بِاللَّهِ وَالْيَوْمِ الآخِرِ ذَلِكَ خَيْرٌ وَأَحْسَنُ تَأْوِيلاً) [النساء: 59]، وقال النبي صلى الله عليه وسلم: ”فإنه من يعش منكم فسيرى اختلافًا كثيرا فعليكم بسنتي وسنة الخلفاء الراشدين من بعدي تمسكوا بها وعضو عليه بالنواجذ”، الحديث هكذا يأمرنا الله ورسوله أننا عند اختلاف العلماء في حكم مسألة من المسائل أننا نأخذ من أقوالهم ما له دليل من الكتاب والسنة ونترك ما خالف الدليل لأن هذا علامة الإيمان بالله واليوم الآخر ولأنه خير لنا وأحسن عاقبة. وأننا إذا أخذنا بما خالف الدليل من الأقوال فإنه يفترق بنا عن سبيل الله ويوقعنا في سبيل التيه والضلال كما أخبر عن اليهود والنصارى أنهم اتخذوا أحبارهم ورهبانهم أربابًا من دون الله، ولما استشكل عدي بن حاتم رضي الله عنه اتخاذهم أربابًا من دون الله بين له النبي صلى الله عليه وسلم أن اتخاذهم أربابًا معناه طاعتهم في تحليل ما حرم الله وتحريم ما أحل الله، وكثير من الناس اليوم إذا رأيته على مخالفة ونهيته عنها قال لك: المسألة فيها خلاف فيتخذ من الخلاف مبررًا له في ارتكاب ما هو عليه ولو كان مخالفًا للدليل فما الفرق بينه وبين ما كان عليه أهل الكتاب الذين اتخذوا أحبارهم ورهبانهم أربابًا من دون الله، فالواجب على هؤلاء أن يتقوا الله في أنفسهم ويعلموا أن وجود الاختلاف في المسألة لا يجيز لهم مخالفة الدليل، حتى صار كثير من الجهال يتتبع الأقوال المسجلة في الكمبيوتر نقلًا عن كتب الخلاف فيفتي بما يوافق هواه من تلك الأقوال من غير تمييز يبنى ما كان عليه دليل صحيح وما ليس عليه دليل إما لجهل منه أو عن هوى في نفسه والجاهل لا يجوز له أن يتكلم في شرع الله بناء على ما قرأه ورآه في عرض تسجيلي وهو لا يعرف ما مدى صحته وما مستنده من الكتاب والسنة، والله لم يأمرنا بالرجوع إلى مجرد ما في الكتاب الفقهي من غير فهم بل أمرنا بسؤال أهل العلم حيث قال سبحانه: (فَاسْأَلُوا أَهْلَ الذِّكْرِ إِنْ كُنْتُمْ لا تَعْلَمُونَ)[النحل: 43]، وصاحب الهوى لا يجوز له أن يتخذ هواه إلهًا من دون الله، فيأخذ من الأقوال ما يوافقه ويدع ما لا يوافقه.
قال الله تعالى: (وَمَنْ أَضَلُّ مِمَّنْ اتَّبَعَ هَوَاهُ بِغَيْرِ هُدًى مِنْ اللَّهِ) [القصص: 50]، (أَرَأَيْتَ مَنْ اتَّخَذَ إِلَهَهُ هَوَاهُ أَفَأَنْتَ تَكُونُ عَلَيْهِ وَكِيلاً) [الفرقان: 43]، ولا يجوز لمن كان عنده علم أن يلتمس للناس ما يوافق أهواءهم فيضلهم عن سبيل الله بحجة التيسير فالتيسير إنما هو بإتباع الدليل لئلا يكون من الذين قال الله فيهم: (لِيَحْمِلُوا أَوْزَارَهُمْ كَامِلَةً يَوْمَ الْقِيَامَةِ وَمِنْ أَوْزَارِ الَّذِينَ يُضِلُّونَهُمْ بِغَيْرِ عِلْمٍ) [النحل: 25]، وفق الله الجميع للعلم النافع والعمل الصالح. وصلى الله على نبينا محمد وآله وصحبه.

Using the Statement ‘There is a Disagreement in the Matter’ as an Evidence

Allah (subhanah wa ta’alah) said what means: (and this is my straight pass, so follow it and do not follow the different paths which will deviate you away from his path). Allah (subhanah wa ta’alah) said what means: (Oh you who believe obey Allah and obey the messenger and those who are in charge amongst you if you truly believed in Allah and the last day). The messenger (Sallah allah alih wa sallam) said what means: (whoever lives amongst you will see great differences. Therefore, take my way and the way of the rightly guided Khalifs after me. Hold on to it to the point of biting on it with you molar teach). Allah and his messenger order us, when the scholars differ, to take from the scholars’ words that which we have a proof of from the book of Allah (subhanah wa ta’alah) or the sunnah (legal way) of his messenger (may allah be pleased with him) and to leave off that which is not in agreement with the proof because this is a sign of true believe in Allah and the last day and because it’s better for us and brings better outcome. Additionally, if we take from the statements that which is not in agreement with the proof, it will take us to the deviant paths and to the ways of misguidance and loss. Similarly to how those who were before us were taken to the deviant paths when they took their saints as gods besides Allah. When A’adi Bin Hatem asked the messenger for clarification on this, the messenger (sallah allah alih wa sallam) replied that when they made that which is permissible impermissible and that which is impermissible was made permissible by them, they were worshiping them. Many people today, if you come to advise them about a particular matter, they will say: “there is a disagreement on the matter”. He will take the disagreement between the scholars as an excuse for what he is upon even if it was against the correct proof. What is the difference between him and the people of the book who took their saints and scholars as gods besides Allah? Those people should fear Allah and know that the difference in opinions in a matter does not give them an excuse not to follow the evidence. The situation reached the point that many ignorant people will follow the statements mentioned on the computer (online) which are copied from the books that gather the different opinions. Those people will give verdicts (fatawah) that suits their desires without knowledge with which they can differentiate between the rule that is based on a correct evidence and one that is not. They do this either out of their ignorance or out of following their desires. An ignorant person does not have the right to speak about the religion of Allah based on what he has read or has seen in a video without knowing how correct and how much is this opinion based on the Quran and the Sunnah. Allah (Subhanah Wa Ta’alah) did not order us to merely go to a book of Fiqh without understanding but rather he ordered us to go to the people of knowledge. Allah (Subhanah wa Ta’alah) said what means: (Ask the people of knowledge if you did not know). Therefore, the person of desires is not allowed to take his desired as a god besides Allah by taking from the different opinions that which suits him and leaving that which does not.
Allah (subhanah wa ta’alah) says what means: (and who is more misguided than the one who follows his desire without guidance from Allah). Also Allah (subhanah wa ta’alah) said what means: (have you seen the one who took his desire as his god). Additionally, it is not permitted for one who has knowledge to misguide people by giving them rules that suits their desires under the umbrella of giving ease. True ease comes by following the evidence. This is so he does not fall under those who allah said about them what means: (They take all of their own sins on the day of judgement and from the sins of those who they misguide without knowledge). May allah guide us all to the beneficial knowledge and to the good actions.
