    In The Name of Allaah, The Most Merciful, The Bestower of Mercy

    Introduction: Abridged


    Ustaadh Abu Mu-aadh [Zaa-id Aala Taahir( may Allaah preserve him) said in his compilation on the affair of Ali Halabi, which was read and revived by Al-Allaamah Rabee Bin Haadee Al-Madkhali (may Allaah preserve him and prolong his life upon goodness):



    Indeed, all praise is due to Allaah; we seek His aid and assistance. We seek refuge with Allaah from the evil of our souls and from the evil of our deeds; whomsoever Allaah guides none can misguide and whomsoever He causes to go astray, then none can guide. I bear witness that none has the right to be worshipped except Allaah, and I bear witness that Muhammad is His slave and messenger….up to the saying of the author: Indeed, the best of speech is the speech of Allaah, and the best of guidance is that of Muhammad (sallal-laahu-alayhi-wasallam), and the worst of all affairs are the newly invented affairs in the religion, and every newly invented affair in the religion is a bidah, and every bidah is misguidance, and every misguidance is in the hell fire.



    The Obligation of Knowledge and Justice in refutation and criticism



    Before commencing with the detailed Mukhaalafaat (i.e. affairs in opposition to the book and the Sunnah) Ali Halabi has newly invented, I would like to remind myself and the reader of some statements of Shaikhul Islaam Ibn Taymiyyah (rahimahullaah) in clarification of the importance of knowledge and justice when criticising and refuting.


    He (rahimahullaah) said: ‘’Allaah loves speech with knowledge and justice, and to give (everything) the rights that belongs to it, and to place the people in their rightful positions.’’ [Majmoo Al-Fataawaa: 12/205]




    He (rahimahullaah) said: ‘’As for Ahlus Sunnah, they give allegiance to all the believers and they speak with knowledge and justice. They are neither from the people of ignorance nor from the people of desires.’’ [Minhaajus Sunnah: 2/17]




    He (rahimahullaah) said: ‘’Speech about the people has to be with knowledge and justice, and not by way of ignorance and oppression.’’ [Minhaajus Sunnah: 4/337]




    He (rahimahullaah) said: ‘’It is known that when I speak about those other than the companions, such as the kings in their differing ruler-ships, the Mashaayikh in their diverse (stations) in knowledge and (adherence) to the religion, then it is obligatory that speech is (carried out) with knowledge and justice, and not with ignorance and oppression; because justice is obligatory upon everyone in all situations, and oppression is absolutely forbidden and is never permissible in (any) situation. Allaah (The Most High) said: ‘’ Help you one another in Al-Birr and At-Taqwa (virtue, righteousness and piety); but do not help one another in sin and transgression.’’ [Soorah: Al-Maa-idah: Ayah: 2]



    This ayah was revealed due to their (i.e. believers) hatred for the disbelievers, and it is a hatred commanded by Allaah. So if the hatred which Allaah has commanded (does) prohibit the person commanded with it from oppressing the one he hates, then how about hatred towards a Muslim who (fell) into false interpretation, affairs of Shubuhaat or (follows) his desires?! He (i.e. this Muslim) is more worthy of being (treated) with justice and not oppressed. [Minhaajus Sunnah: 5/126-127]



    He (rahimahullaah) said: ’’The just amongst men is the one who informs of an affair the way it is; he neither adds to it and becomes a liar nor does he subtract from it and becomes a concealer.” [20/84]




    After quoting these statements and what is similar to them, Ustaadh Abu Mu-aadh said:


    And by way of knowledge, the Muslim comes of know truth (as opposed) to falsehood, correctness (as opposed) to mistake, and he distinguishes the people of truth from the people of falsehood, and he judges (whilst) neither going beyond bounds nor falling short.

    And another affair which must be clarified here is that the people of knowledge have a status (mentioned) in the Book, the Sunnah and in the creed of the pious predecessors. Indeed, Allaah made them witnesses to the greatest testimony, and that is the testimony to His Oneness and Justice. He said: ‘’Allah bears witness that La ilaha illa Huwa (none has the right to be worshipped but He), and the angels, and those having knowledge (also give this witness); (He is always) maintaining His creation in Justice. La ilah illa Huwa (none has the right to be worshipped but He), the All-Mighty, the All-Wise.’’ Soorah Aali Imraan: Ayah: 18]



    And they (i.e. the people of knowledge) have not been placed in that (station as witnesses to the greatest testimony), except that they are from those He (Allaah) is pleased with, then how can a servant not be pleased with them in (their) clarification of His (Allaah’s) religion. And also is the fact that they (i.e. the people of knowledge) are the intermediaries [between Allaah, His Messenger and the people (i.e. the people of knowledge convey the book and the Sunnah to the people); rather Allaah (appointed) them as the ones to be referred to, with regards to the clarification of the truthfulness of the Messengers.



    He (The Most High) said: ‘’And We sent not (as Our Messengers) before you (O Muhammad) any but men, whom We inspired, (to preach and invite mankind to believe in the Oneness of Allah). So ask of those who know the Scripture [learned men of the Taurat (Torah) and the Injeel (Gospel)], if you know not.’’ [Soorah An-Nahl: Ayah:43] up until Ustaadh Abu Mu-aadh said:



    But this station (of the scholars) has to be within the boundaries of the legislation and it is not to enter into the prohibited boundary. The legislated boundary is to hold onto them in following the evidences, proofs etc; and the prohibited boundary is that we have partisanship to their statements without proof and evidence, or that we form a partisanship around them, loving and hating for the sake of their personalities. [Then the author quoted few other statements of Shaikhul Islaam about the prohibition of establishing allegiance and enmity based on other than the statements of Allaah and His Messenger, and the Ijmaa. And that it is ahlul bidah who appoint for the Ummah personalities and bring about statements through which the Ummah splits etc. [see page: 8-9 in the PDF]



    Then Ustaadh Abu Mu-aadh quotes Shaikhul Islaam on page 9, who said:


    If a teacher or an ustaadh commands with the boycotting of a person, or that he is to be killed, or that he is to renounced, distanced and the likes; the affair is looked into: If he (i.e. this person) committed a sin (in violation of the sharia and for which there is a prescribed sharia punishment) then he is punished in accordance to the degree of his sin without an increase (in that). And if it is a sin (for which there is not a prescribed punishment in the sharia), then it is not permissible to punish him with anything for the sake of the teacher’s desire or other than it. And it not for the teachers to make the people into partisans and do that which (brings about) enmity and hatred between them!! Rather, they should be brothers helping one another upon Bir and Taqwaa, as Allaah (The Most High) stated: ‘’Help you one another in Al-Birr and At-Taqwa (virtue, righteousness and piety); but do not help one another in sin and transgression.’’ [Soorah: Al-Maa-idah: Ayah: 2] And it not for anyone amongst them (i.e. the teachers) to take an agreement from anyone that he (i.e. that person) is to agree with him in everything he wants, and that he (i.e. the person) is to ally with the one who is allied to him (i.e. the teacher), and that he is to have hatred for the one who has hatred for him (i.e. the teacher)!! The one who does this is from those (similar) to Genghis Khan and his likes; those who befriend the one who agrees with them and (declare) the one who disagrees with them an enemy and evil doer; rather incumbent upon the teachers and their followers is the covenant of Allaah and His Messenger, that they obey Allaah and His Messenger, and that they carry out what Allaah and His Messenger commanded, and (declare) unlawful what Allaah and His Messenger (declared) unlawful, and that they appeal for the rights of the teachers just as Allaah and His Messenger commanded.[Mahmoo Al-Fataawaa: 15/25-28]



    This is the path of justice. Shaikhul Islaam Ibn Taymiyyah (rahimahullaah) said: ‘’The one who follows the path of justice will exalt the one worthy of being exalted and he will love and ally with him; he will give the truth its due right, exalt the truth and show mercy to the creation.’’ [Minhaajus Sunnah: 4/544]


    We ask Allaah to grant us beneficial knowledge, and that He aids us towards speech that is based on justice, and that we are not from the people of ignorance or oppression. Allaah is the granter of success.
